| August 17th 1824. In the name of God, Amen!
I Travis Marable of the county of Rutherford and State of Tennessee, calling to mind that it is once appointed for all men to die, and being in my right mind and memory and being desirous to settle my worldly affairs according to my own desire do make and ordain this my last will and testament, disposing of my worldly goods in the manner following; After payinng all my just and lawful debts. I give and bequeath to my beloved wife Martha Marable, one negro man named Jeffrey, and his wife Cloe [?], one negro boy named Daniel, also one named Bob and one body named Tom, also one girl named Molly all of the above negroes I lend during her natural life or widowhood, also with all the stock that belongs to the plantation with all the plantation utensils & household furniture, and it is also my will and desire that upon the proceeds of this property my wife would raise and educate the children free from [illegible] also my desire I will that the plantation should remain as hers, whereon I now live, during her natural life or widowhood, it is also my will and desire that should my wife marry she shall be entitled to one third of all the above named property -- It is also my desire that my debts be paid out of my present crop and the balance for the benefit of the family. It is also my will and desire that one negro boy Joe, one negro boy and Abel, also one negro woman Mary shall be equally divided amongst my five children, Mary Anna, Martha Jane, James Alexander, Isaac, John. It is my desire that when my youngest child John becomes of age the above negroes shall be divided equally and at my wife's death all the property that is given to her shall be equally divided amongst the above named children. Confiding in the Justice and faithfulness of Henry H. Marable and Benjamin Marable I do appoint them executors to this my last will and testament -- In witness whereof I have hereunto set my hand and affixed my seal the day and year first before written. | In the name of God Amen, I Henry H. Marable of Rutherford
County, Tennessee, do make and ordain this my last will and Testement.
In the first place I desire that all my just debts be fully paid and satisfied as soon as Convenient after my decease. Item I give and bequeath unto my beloved wife Elizabeth my black man Edlod, and his wife Sukey and also William Bennetts and James Mortimbind fer [?] four hundred dollars, together with all my household furniture to her and her heirs forever. Item I give and bequeath unto my son Benjamin Benjamin [sic] Marable after his mothers death, the sum of five hundred dollars to him and his heirs forever. Item I give and bequeath unto my two grand daughters Martha L. and Elizabeth Isaac Marable, at the death of my wife the sum of two hundred and fifty dollars each to them and their heirs forever. Item I give unto my daughter Elizabeth H. Jones at the death of her mother, the Sum of five hundred dollars to her and her heirs forever. Item I lend unto my aforesaid beloved wife Elizabeth during her natural life, my land and plantation, all my negroes, horses, cattle, and Stock of every Kind together with all my plantation utensils, Kitchen furniture, tools of every Kind also my Corn, wheat, oats and fodder, together with every other article belonging to me, whether named or not. Item at the death [of] my beloved wife aforesaid I will and direct that all the above enumerated property (in the last item) be divided as followeth viz. one Seventh part thereof to my son Benjamin to him and his heirs forever. One Seventh part unto my Son John H Marable to him and his heirs fer [?] one Seventh part unto the Sons of my Son Travis H Marable to them and their heirs forever, one Seventh part unto my Son Henry H Marable to him and his heirs forever, one Seventh part unto the heirs of my Son Isaac Mason Marable to them and their heirs forever, one Seventh part unto my daughter Elizabeth H. Jones to her and her heirs forever. And one Seventh part thereof unto my son John H. Marable in trust for the use and benefit of my son Braxton Marable and his wife and after their death for the benefit of their children. I nominate, Constitute and appoint my Son Benjamin Marable John H Marable and Henry H. Marable executors of this my last will and testement. I do hereby utterly revoke all former wills by me at any time made, confirming this and no other. In witness whereof I have herewith Set my hand and affixed my Seal this 27th day of June, one thousand eight hundred and thirty-one. Henry H Marable {Seal}
